Last article, I gave the example of a man with children from a prior relationship who purchased a home with his girlfriend.\u00a0 <\/span>When he dies, who will receive his share of the home?\u00a0<\/p>\n

Since they are not married, the house is not community property.\u00a0 <\/span>This means there is no presumption that his share of the home will go to her. \u00a0 \u00a0<\/span><\/p>\n

Without a will, his share of the home will likely go to his children.\u00a0 <\/span>At his passing, she will own part of the home and his children will own the rest.\u00a0 <\/span>She may want to continue living there.\u00a0 <\/span>However, the children may want to move into the home, sell it, or rent it out.\u00a0 <\/span>She may dislike all of those options.\u00a0 <\/span>Unless they are all in agreement, a fight may well ensue.<\/p>\n

There is another question that must be answered.\u00a0 <\/span>Since this man and his girlfriend purchased the house together, how much do each of them own?\u00a0 <\/span>Unless they each paid exactly half of every cost (including the mortgage, insurance, taxes, repairs, etc.), that question will be very difficult to answer.\u00a0 <\/span>If his estate is passed on to the children, how much of the value of the home is he actually passing on?\u00a0 <\/span>The answer may create its own fight.\u00a0<\/p>\n

It is difficult when a loved one passes.\u00a0 <\/span>Without proper preparation, this example \u2013 and so many others like it \u2013 make a difficult time that much worse.\u00a0 <\/span>Different parties, each dealing with their own grief, have different understandings of what the deceased would have wanted.\u00a0 <\/span>Without a will, the law may impose a result none of them wanted.<\/p>\n

The solutions do not have to be difficult.\u00a0 <\/span>A few simple techniques, including a will, can answer these questions simply and effectively.\u00a0 <\/span>That result will not happen automatically.\u00a0 <\/span>Don\u2019t give up control of what will happen to your estate when you pass by failing to properly plan.<\/p>\n
