A brief history about Disability Law:

Disability law has seen a significant evolution over the years. In 1990, the Americans with Disabilities Act (ADA) was passed by Congress and signed into law by President George H.W. Bush. This landmark legislation forbids discrimination against individuals with disabilities in employment, public services, transportation, and other areas of everyday life. The ADA also requires businesses and other public accommodations to make reasonable modifications to accommodate individuals with disabilities.

In 2008, the ADA Amendments Act (ADAAA) was passed, which broadened the definition of “disability” under the law and made it easier for individuals to qualify for protection under the ADA. The ADAAA also clarified that mitigating measures, such as corrective devices or medications, should not be considered when determining whether an individual has a disability.

More recently in 2018, the Supreme Court ruled on two cases that expanded the scope of protection for individuals with disabilities. In United States v. Bostock, the Court held that Title VII of the Civil Rights Act of 1964 protects against discrimination on the basis of sexual orientation and gender identity. This ruling also extended protections to individuals with disabilities, who had previously been excluded from Title VII’s protections. In another case, Epic Systems Corp v. Lewis, the Court held that employers may require employees to waive their rights to participate in class action lawsuits as a condition of employment. Despite the criticism this decision has drawn, it may provide expanded protection for individuals with disabilities in the workplace.

These changes to disability law have helped create a more equitable society and ensure that individuals with disabilities receive the same rights and protections as everyone else. While there is still work to be done, these precedent-setting cases demonstrate that progress is being made toward protecting the rights of people with disabilities.

It is essential that this progress continues, as individuals with disabilities still face discrimination and unequal treatment in many areas. All individuals deserve to be treated fairly and equally regardless of their physical or mental abilities, which is why it is important to keep fighting for disability rights. By continuing to push for greater inclusion and accessibility, we can make sure that the rights of people with disabilities are respected and protected.
